Is it safe to buy a beach house in Brazil? Title deeds, posse and how to check

Until recently, São Miguel do Gostoso was a fishing village. Land passed from parents to children without paperwork, and many plots near the beach were sold with a receipt and possession only. When the town became a destination, those properties came onto the market as they were.
So in a place like Gostoso, the first question is not the price. It is whether the property has a matrícula at the registry, and whether the person selling is the owner on that record.
Escritura vs posse: what are you actually buying?
With escritura and matrícula, you buy the property. The matrícula is its record at the Real Estate Registry, showing the owner and any mortgage, lien or claim. The escritura is the public deed of sale, signed at a notary and then recorded on the matrícula.
With posse, you buy a right of possession, usually through a private contract (contrato de cessão de posse). Possession can become ownership through usucapião, a court or notary process based on long-term occupation, but that takes time and is not guaranteed.
What are the risks of buying posse property?
Banks do not finance property without a registered matrícula. That hits you twice: you pay cash, and whoever buys from you later also has to pay cash, which shrinks your pool of buyers.
Someone can appear claiming to be the owner, or an heir can contest an old sale. For a holiday home or a place to live, few people want that doubt over the family house.
Posse is not always a bad deal. It means the price must reflect the risk, and you must know exactly what you are buying. For foreign buyers, especially those who want to use the property for residency, a recorded deed is the safe choice: the residency rules require it.
What should you check before you pay?
Your lawyer should get and read these documents before you sign the purchase agreement or pay a deposit.
- An updated certificate of the matrícula, issued within the last 30 days. The seller's name must match.
- The seller's personal certificates: civil, labor, federal and tax court searches, and protest records. A seller's debts can reach the property. [CONFERIR with lawyer: final list of certificates]
- Property tax (IPTU) paid up to date.
- Built area on record matching what is actually there.
- In a gated community, a statement that condominium fees are paid.
- Whether the plot is federal coastal land (terreno de marinha), and if so, its status with the SPU, the federal property office.
- For rural land, whether INCRA approval is needed for a foreign buyer.
What is terreno de marinha, and what is laudêmio?
Terreno de marinha is federal land along the coast. Many beachfront plots in Brazil sit partly or fully on it. You can hold it, but the federal government keeps an interest and charges fees.
There is an annual fee: 0.6% of the land value under the aforamento regime, or 2% under the occupation regime. When the property is sold, a laudêmio of 5% is due to the federal government. Sources disagree on whether the 5% applies to the land only or to land plus buildings. [CONFERIR with lawyer: laudêmio base]
Foreigners also face a specific rule in the 100 meter strip along the coast. Under Decree-Law 9,760/1946 (art. 205), federal property there can only go to a foreigner with federal authorization. The exceptions are a unit in an urban condominium, with foreign owners holding no more than one third of the area, and, for individuals, a plot of up to 1,000 m².
Why hire an independent lawyer?
Your broker is paid when the sale closes. Your lawyer is paid to protect you, whether or not it closes. Serious legal guides repeat this for a reason: an independent review of the title, the contract and the payment terms is cheap compared with fixing a bad purchase.
Agree on the scope and the fee in writing. A good lawyer will tell you plainly when to walk away.
How do I work in São Miguel do Gostoso?
Before I list a property, I check the paperwork and who the owner is. When there is an issue that can be fixed, I tell you what it is, what it costs and how long it takes, before you decide. Then your lawyer checks everything independently.
If you are buying from abroad, you do not have to fly in to know the house is right. I send the documents to you and your lawyer and follow the process through to the recorded deed.

Is it safe for a foreigner to buy property in Brazil?
Yes, when the property has a clean matrícula in the seller's name and an independent lawyer checks it before you pay. Foreigners buy urban property on the same terms as Brazilians.
What is the difference between escritura and posse?
With escritura recorded on the matrícula, you own the property. With posse, you hold only a right of possession under a private contract, with no registered ownership.
Can I get a mortgage on a posse property?
No. Banks only finance property with a registered matrícula in the seller's name.
What documents should I ask for before buying a beach house in Brazil?
An updated matrícula certificate, the seller's personal certificates, proof that property tax is paid and, in a gated community, proof that condominium fees are paid. On the beachfront, check for federal coastal land.
What is laudêmio?
A 5% fee paid to the federal government when federal coastal land (terreno de marinha) is sold.
Do I need a lawyer to buy property in Brazil?
It is not legally required, but every serious guide recommends one. Your broker does not replace your lawyer.
